Welcome to install, use, and/or register as member of the Membership Program (as defined below) through, the mobile application (“this Application”) operated by Ikigai Concepts Limited (“Ikigai Concepts”). Please read the following Terms of Use of this Application (“Terms of Use”) carefully. Your login, use and/or installation of this Application means that you have accepted and agreed to be bound by these Terms of Use. If you are unwilling to be bound by these Terms of Use, please do not use or access this Application.

When you use this Application to register as a member under the Ikigai Concepts Membership Program (“Membership Program”), a member loyalty program operated by Ikigai Concepts, you are required to complete the relevant form and provide certain details. A click/press on the “submit”, “accept”, and/or “confirm” buttons through this Application indicates that you have read and fully understood the terms and conditions of the Membership Program and agreed to be bound by them.

Ikigai Concepts reserves the right to change or modify any of the contents of this Application at any time and the right to unilaterally change any part(s) of these Terms of Use without any notification. You should regularly visit or access this Application to find out whether these Terms of Use that are binding on you have been revised, as your continued use or access of this Application indicates your acceptance of all such modified and new Terms of Use which will also apply to your subsequent use or access of this Application and/or the contents therein. “You”, “your”, “user” and/or “member” refer to any person that accesses this Application.

1. Description of services

1.1 Application
This Application provides information about Ikigai Concepts, Membership Program registration, menu, coupons, outlets location and contact method. This Application shall mean the software provided by Ikigai Concepts to offer services related to Ikigai Concepts to be used on Apple iOS and Android devices and any upgrades therefrom from time to time and any other software or documentation which enables the use of this Application.

1.2 Availability
This Application is available to handheld mobile devices running Apple iOS or Android Operating Systems. Ikigai Concepts will use reasonable efforts to make this Application available at all times. However, you acknowledge that this Application is provided over mobile networks and so the quality and availability of this Application may be affected by factors outside Ikigai Concepts’ reasonable control. Neither Ikigai Concepts, its affiliates, its service providers and sub-contractors shall have any responsibility or liability whatsoever for any unavailability of this Application or its contents or any webpage or website embedded therein, or any difficulty or inability to download or access content thereof or any other communication system failure which may result in this Application being unavailable. Certain contents of this Application may be offered by third parties not affiliated with Ikigai Concepts. Ikigai Concepts is not responsible for and does not endorse any content made available through this Application that originates from a source other than Ikigai Concepts.

1.3 System Requirements
In order to use this Application, you are required to have a compatible mobile telephone or handheld device, internet access, and the necessary minimum specifications (“Software Requirements”). The Software Requirements are: Only applicable to mobile devices using iOS 12.0 or above and Android 8.0 or above. The version of this Application software may be upgraded from time to time to add support for new functions and services.

2. Conditions of Use

All the Materials (as defined in clause 8 below) contained within this Application is/are for your reference, interaction with Ikigai Concepts or, where applicable, purchase only for your individual use purposes. You will not, nor allow any person on your behalf to:

(a) make use of or distribute copies of such Materials;

(b) in any way, disseminate, announce, spread, revise, display or sell (or offer to sell) any of the products (or any part thereof) described in or made available through this Application;

(c) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate any of such Materials (or any part thereof); or

(d) create derivative works of any kind whatsoever in respect of any of such Materials (or any part thereof),

for any commercial purposes

2.1.
Ikigai Concepts reserves the right to amend or withdraw this Application, or charge for this Application or service provided to you in accordance with these Terms of Use, at any time and for any reason. You acknowledge that the terms of agreement with your respective mobile network provider and internet provider (“Mobile Provider”) will continue to apply when using this Application. As a result, you may be charged by the Mobile Provider or other third parties for any access to network connection services or data fees for the duration of the connection while accessing this Application or the links and/or viewing the contents therein. You accept responsibility for any such charges that arise.

3. Personal Information Collection Statement

When you use this Application, and/or register as member of the Membership Program, you may have to provide to Ikigai Concepts your personal data (including but not limited to your name, gender, birthday information, age, phone number, email address and contact information) (collectively, “Data”) or other information. You agree to provide to Ikigai Concepts such Data and other information voluntarily.

You accept and agree that for the purpose of providing you certain products/services (e.g. promotional offers news, delivery of e-coupons), Ikigai Concepts may use or combine your Data or information with other information (including but not limited to the location data and the International Mobile Equipment Identity number) accessed in your mobile device. You hereby give your consent to Ikigai Concepts to access such Data and information in your mobile device.

If you fail to provide such Data or information or the Data or information you provided is incomplete or incorrect, Ikigai Concepts will be unable to provide or continue to provide related products/services, or may not allow you to enter or may discontinue your use of this Application. You assure that all the Data and information you provided to or collected by Ikigai Concepts is correct, truthful, valid and complete. Otherwise, Ikigai Concepts has the right, without notice, to cancel your registrations, eligibility and qualifications and/or refuse to allow you to use this Application or access any contents, products/services offered therein from time to time or in the future. For details of Personal Information Collection Statement, please refer to the Privacy Policy Statement of Ikigai Concepts [insert hyperlink] available on its website and this Application.

4. Management and Responsibilities

When registering as a member of the Membership Program through this Application, you are required to select your own username and password which shall be used to log into and conduct the activity(ies) and/or transaction(s) within the Member Zone (see below) through this Application. You may reset your password by clicking the “Forget Password” button and following certain procedures from time to time. You must keep your username and password confidential solely for your own use and shall take all precautious measures to safeguard such username and password from loss, stolen, misappropriation or unauthorised use by any other person(s). Ikigai Concepts will not be responsible, whether or not you are aware of it, for any losses, damages, claims and/or liabilities whatsoever caused or incurred as a result of the use of such username and password, and in this case, you agree to remain responsible for any and all activity(ies) and/or transactions carried out through this Application by using such username and password.

If you breach of any of these Terms of Use, or Ikigai Concepts suspects that you are in breach of any of these Terms of Use, or Ikigai Concepts believes that your actions have violated any applicable laws or damaged the interests or reputation of Ikigai Concepts, any of its affiliates or other users of this Application, Ikigai Concepts reserves the absolute right to without notice to you revoke your registration, eligibility and qualifications, or terminate your access to this Application and the contents therein or your use of any services offered in this Application, and take legal action against you.

5. Member Zone

Member’s Zone for the Membership Program and its services provided in this Application are for use by the individual Ikigai Concepts’ registered member only. Access rights to such Member’s Zone cannot be transferred. Members may be asked to provide personal identification for verification. Ikigai Concepts reserves the right to suspend this service or any parts of the service for repairs, maintenance, upgrades or any other work Ikigai Concepts deems appropriate without prior notice.

This Application allows you to earn, collect and redeem IKG Points within the Member’s Zone. For details of the IKG Points and their earning, collection and redemption, please refer to the relevant terms and conditions of the Membership Program www.ikg.hk/membership/.

6. Promotional Activities

Ikigai Concepts will periodically carry out promotional activities on this Application. If the promotional activity involves earning or accumulating IKG points or other rewards, Ikigai Concepts will be the final arbitrator of the total IKG Points earned or awarded according to its records and you shall not dispute such decision.

7. Underage Persons

If you are under 18 or considered as a minor by law or do not have the ability to make a contract or are unable to bear any legal responsibility, and when using this Application gives rise to legal obligations or responsibilities, you should not provide any personal information described in these Terms of Use and will not be allowed to use this Application. If you want to enter and browse this Application or accept the Terms of Use or any other terms through this Application, you must seek for approval from your parent or guardian regarding the legal implications of these Terms of Use and such terms as well as the consequences that entail. Ikigai Concepts assumes that all users of this Application and all members of the Membership Program are of legal age. Ikigai Concepts is not obliged to check your age but if it is found that any user is underage, Ikigai Concepts reserves the right to take action against such user/member or his/her parents/guardian including cancelling your registration or refusing your access to this Application.

8. Use of Materials

The contents of this Application, including diagrams, images, music, symbols, links, trade mark, software and other information and materials contained in, and services and/or products available through, this Application (collectively, “Materials”) are protected by copyright law, trade mark law and other applicable laws. All Materials are the exclusive property of Ikigai Concepts or its supplier(s), service provider(s) and/or client(s). Unauthorized use of any of such Materials may be considered as an intellectual property infringement under the applicable laws. Without any prior written permission from Ikigai Concepts, you shall not, for any public or commercial purpose, sell or modify any of the Materials, copy, reproduce, re-issue, upload, download, publish, transmit, display, publicly implement, issue the Materials in any way, store the Materials in the retrieval system or use it in any other way.

9. Legal Use of Application

You can only use this Application for legal purposes and cannot use this Application to, in any way, infringe the intellectual property rights of any other person or invade the privacy of other users or acquire their identities or any other personal details, or damage any part of this Application, the Materials and/or products provided in this Application. You have the responsibility to judge whether any of your actions will infringe the rights as described above and will seek your own professional advice as to the implications arising from such actions.

You shall not, in any way, change any of the Materials provided in this Application and shall not interfere with the operation of this Application in any way, including but not limited to, transmitting any software viruses, any computer code or message designed to shut down, interfere with the operation or alter the interface of, this Application. You shall also not use any way to collect any information or details of other users of this Application unless such information or details are given to you directly by such user(s). Without express permission from Ikigai Concepts, this Application or any part thereof shall not be reproduced, copied, printed, sold, transferred or used for any commercial purposes.

10. Limitation of liability

There may be incorrect material or typesetting errors in this Application. Ikigai Concepts does not give any implied or non-expressed guarantee and does not guarantee the correctness, reliability, completeness or timeliness of the Material(s) contained in this Application.

Ikigai Concepts does not accept any liability whatsoever for the information or content embedded in any link(s) provided in, or uploaded to, this Application, including but not limited to any errors, omissions, infringements, libel or any other material or omission that is likely to be illegal or gives rise to a claim or complaint. You will be responsible for any consequences resulting from use of this Application or such link(s) or the information or content embedded therein. These links or the information or content embedded therein are likely to change at any time or change periodically, so please check them regularly.

Ikigai Concepts does not guarantee the following: this Application will be totally free of errors now and in the future, this Application and its server will always be free of computer viruses, system failure, malfunction or other harmful function or that this Application is timely, safe and will not be discontinued. If your use of this Application or any Materials contained therein results in the need to repair or renew any equipment or data, Ikigai Concepts accepts no liability and shall not be liable for any claims, losses, damages, costs and/or expenses whatsoever arising out of any such failure, repair or renewal, whether or not you own such equipment or data.

Ikigai Concepts and any third party mentioned in this Application shall not, to the extent permitted by law, be responsible for any liability, claims, loss, damage or injury whatsoever (including, but not limited to, accidental damage, indirect damage, loss of profit, or damage resulting from the loss of data or business interruption) arising from a breach of contract, an infringement act, negligence or any other act or omission, directly or indirectly, through the use or inability to use this Application or any of the Materials contained therein, or any implementation failure, error, omission, discontinuation, deletion, deficiency, delay in operation or transmission, computer virus, communication cable malfunction, interception of on-line communication, soft or hard ware problem (including but not limited to the loss of data or compatibility problems) or theft, whether or not a result of the use of this Application or the uploading to or downloading from this Application any data, text, images or other Materials or information, and regardless of whether Ikigai Concepts has been notified of the likelihood of such loss, damage or injury.

Notwithstanding anything contained herein or in any other terms and conditions set out in this Application, Ikigai Concepts shall in no event be liable for any indirect, consequential, incidental, economic, special or punitive loss or damages nor any loss of revenue, loss of profit or loss of contracts arising out of or in connection with the installation, use, access or download of this Application and/or any of the Materials contained therein.

11. Indemnity/ Compensation

You agree to indemnify, hold harmless and defend each of Ikigai Concepts, its affiliates and their respective employees, directors, officers, agents, service providers and contractors (collectively, “Indemnified Parties”), against any and all losses, damages, claims, liabilities, costs (including without limitation legal costs and disbursements) and expenses however incurred or suffered arising out of or in connection with any unauthorized use of any of the Materials through this Application, any activity or transaction conducted through your username and/or password, your infringement of the intellectual property right or other rights of any person and/or your non-compliance with any of these Terms of Use. You further agree to take all precautious measures to prevent or mitigate such losses, damages, claims, liabilities, costs (including without limitation legal costs and disbursements) and expenses, which shall be compensated or paid to such Indemnified Party(ies) upon demand.

Ikigai Concepts has the right to apply for a restraining order in addition to any remedies provided hereunder and any other remedies under common law or in equity.

12. Interpretation of Agreement

Clause headings and examples are provided for reference purposes only to assist in understanding these Terms of Use. They are not intended to define, or limit the scope or extent of any clause.

13. No Waiver

Ikigai Concepts’ failure or delay in exercising any right or power under these Terms of Use shall not in any circumstances impair any of its right or power under these Terms of Use or applicable law, nor operate as a waiver of it.

14. Assignment

Ikigai Concepts may assign its rights and obligations under these Terms of Use. But you may not assign any of your rights and obligations under these Terms of Use.

15. Severally

If any single provision or any one or number of provisions in these Terms of Use when cited, in any situation, is/are in any respect, for any reason, judged to be invalid, illegal or unenforceable, the effectiveness, legality and enforceability of such provision(s) or condition(s) in any other respect, and the effectiveness, legality or enforceability of the remaining provisions of these Terms of Use, will not be affected in any respect.

16. Applicable Law

These Terms of Use are governed by and shall be construed in accordance with the laws of the Hong Kong and you agree to submit to the exclusive jurisdiction of Hong Kong courts for any disagreement, dispute or claim arising out of or in connection with this Application and/or its use or operation.

18. Exclusion of Third Party Rights

Save for Ikigai Concepts, its affiliated companies and the user of this Application, no person shall have any right under the Contracts (Rights of Third Parties) Ordinance (Cap.623 of the Laws of Hong Kong) to enforce or to enjoy the benefit of any term under these Terms of Use.

19. Version Discrepancy

If there is any inconsistency or conflict between the English version and Chinese version of these Terms of Use, the English version shall prevail.

歡迎閣下安裝、使用或／及登記成為Ikigai Concepts手機應用程式（下稱「本應用程式」）的會員。請仔細閱讀本應用程式的使用條款（下稱「使用條款」）。鑒於閣下對本應用程式的安裝或／及使用意味著閣下已接受及同意以下條款，故如閣下不想接受下列條款的約束，請勿使用本應用程式。

當閣下使用本應用程式登記成為會員，填妥登記表格及按下「遞交」、「接受」、「確認」等，即表明閣下已詳細閱讀及了解Ikigai Concepts會員計劃條款及細則，亦同意受有關條款及細則所約束。

Ikigai Concepts保留權利可隨時更新及更改本應用程式內容，並有權單方面修改使用條款而不另作通知。閣下應定期瀏覽本應用程式，以了解對閣下具有約束力的使用條款是否有所修改。在此，「閣下」和「使用者」乃指以任何理由或目的進入本應用程式之所有個別人士及／或實體。

1.服務內容

1.1. 本應用程式

本應用程式提供Ikigai Concepts簡介、最新消息、會員登記、累計積分、查看餐單、分店位置及聯絡Ikigai Concepts的方法。有關Ikigai Concepts服務應用於運行 Apple iOS 及 Android 系統裝置上的應用程式，包括本應用程式的不時更新的版本，以及所有令本應用程式可被使用的軟件或文件。

1.1.1. 可用性

本應用程式適合於裝有 Apple iOS 或 Android 系統的手持裝置上。Ikigai Concepts將合理地作出努力，讓本應用程式於任何時候均可使用。然而，閣下亦同意本應用程式乃經移動網絡提供，其品質或可用性將受外界因素影響，而Ikigai Concepts對此等因素未必能合理地控制。當本應用程式無法使用、內容難以或無法下載或使用，或因通訊系統故障令本應用程式無法使用時，Ikigai Concepts、其關聯公司或其承辦商，均不會承擔任何責任。

1.1.2. 系統要求

閣下必須擁有兼容及有上網功能的流動電話、手持裝置、流動網絡連接，並符合最基本的規格要求（「軟件要求」），方能使用本應用程式。該等軟件要求：只適用運行 iOS 12.0 或以上及 Android 8.0 或以上版本操作系統之手機。該等軟件要求，或將被不時升級，以支持新功能及新服務。

2.使用條件

本應用程式所包含的資訊僅供參考、互動及購物之用，亦只為個人使用用途。閣下不可進行，亦不可容許第三者以閣下名義於本應用程式進行：

(A) 復制並將復制本加以分發；

(B) 以任何方式散布、公布、傳播、修訂、展示、銷售其內容或產品；

(D) 從其中創造衍生性作品或對之加以利用。

閣下謹此承認對本應用程式內容未經授權的使用，可能給Ikigai Concepts造成難以彌補的損害，故若發生未經授權的使用，Ikigai Concepts有權在可能獲得的任何普通法下或衡平法下的其他救濟之外申請禁制令。

2.1.

Ikigai Concepts保留權利隨時及以任何理由修改或撤回本應用程式，或就使用本應用程式或享用本應用程式所提供的服務，按本應用程式使用條款向閣下收取費用。閣下確認並同意閣下與流動網絡供應商所簽訂的合約條款，於使用本應用程式時將繼續適用。因此，閣下在接通網絡使用本應用程式期間，或將被該流動網絡供應商收取網絡連接費用或其他第三方費用。閣下同意自行承擔此等費用。

3. 個人資料收集聲明

當閣下使用本應用程式或／及登記建立帳戶，閣下可能須向Ikigai Concepts提供閣下的個人資料（「資料」），包括但不限於閣下的姓名、性別、生日資料、年齡、手機號碼、電子郵件地址及聯絡資料。閣下同意此等資料是閣下自願向Ikigai Concepts提供。

當閣下使用本應用程式，即表示確認並同意，為了向閣下提供某些服務（例如，優惠通知、傳送電子優惠券），Ikigai Concepts可能會將閣下的個人資料跟其他從閣下的手提電話取得的資料（包括但不限於位置資料、國際移動設備辨識碼）合並使用。閣下現同意Ikigai Concepts可從閣下的手提電話取用該等資料。

若閣下提供的資料不齊全或不正確，Ikigai Concepts將無法向閣下提供或繼續提供有關服務，或可能不容許或終止閣下進入本應用程式。閣下須向Ikigai Concepts保證所提供的資料為准確、屬實、有效和完整的。否則，Ikigai Concepts有權在閣下不獲知會的情況下取消閣下的登記及資格或／及拒絕閣下於現時或將來使用本應用程式及其提供之服務。有關個人資料收集，詳情請參閱Ikigai Concepts的私隱政策及聲明。

4. 賬戶保管及責任

在登記建立帳戶時，閣下可能須選取用戶名稱及密碼。閣下必須對用戶名稱及密碼保密，並負責以該用戶名稱及密碼而進行的任何活動。Ikigai Concepts不負責任何在閣下知情與否下，因他人盜用閣下用戶名稱及密碼而進行的任何活動而帶來的損失，但在這情況下，閣下同意仍必負責以該用戶名稱及密碼而進行的任何活動或因此為Ikigai Concepts帶來的損失。

若閣下違反任何使用條款，或Ikigai Concepts懷疑閣下違反任何使用條款，或Ikigai Concepts相信閣下之行為已違反適用之法例或損害Ikigai Concepts、其關聯公司或其他用戶的利益，Ikigai Concepts保留絕對權利於閣下不獲知會的情況下撤銷閣下的帳戶登記及資格，或終止閣下進入本應用程式及使用其服務，並向閣下采取法律行動。

5. 會員專區

本應用程式內的會員專區及其服務只開放予Ikigai Concepts會員，使用權不可轉讓。會員可能會被要求提供身份證明以核實身份。Ikigai Concepts有權不作事先通知而暫停該服務或其任何部份，以作維修、保養、更新或其他Ikigai Concepts認為適合的工作。

閣下可透過本應用程式賺取及使用Ikigai Concepts積分。此用途須受Ikigai Concepts會員計劃條款及細則約束，詳情請參閱Ikigai Concepts會員計劃的條款及細則www.ikg.hk/membership/。

6. 促銷活動

Ikigai Concepts將不時在本應用程式上進行促銷活動。如有關促銷活動涉及賺取或累積積分或其他獎賞，則應以Ikigai Concepts根據其紀錄所確定的積分為最終決定，閣下對Ikigai Concepts之最終決定不得異議。

7. 未成年人士

如閣下未滿十八歲，或在現行法律下被視為未成年，或無能力締結合同，或不能承擔法律責任，而使用本應用程式將引起任何法律義務或責任時，閣下不可提供使用條款所述之個人資料及不允許使用本應用程式。如果閣下希望瀏覽和進入本應用程式，有關使用條款之含義及其引致之後果，閣下必須徵求父母或監護人的意見。Ikigai Concepts假設本應用程式的所有使用者都已達法定年齡。Ikigai Concepts沒有義務核實閣下的年齡，但如果發現本應用程式的任何使用者未達法定年齡，Ikigai Concepts保留向此等使用者或其父母或監護人采取行動的權利，包括取消閣下帳戶登記的權利及終止閣下進入本應用程式。

8. 材料的使用

本應用程式的內容，如圖形、圖像、音樂、標識、鏈路、商標、軟件和其他材料（以下統稱「材料」）均受版權法、商標法和其他適用法律的保護。所有材料均屬Ikigai Concepts或其供應商或客戶的專有財産。未經授權擅自使用任何材料將違反著作權法、商標法和其他適用法律。未經Ikigai Concepts事先書面同意，閣下不得為任何公共或商業目的銷售或更改材料，或者復制、重制、再版、上載、下載、登載、傳送、顯示、公開執行或以任何方式發送材料，或將材料存儲於檢索系統，或以其他任何方式使用材料。

9. 本應用程式的合法用途

閣下只可使用本應用程式作合法用途，不可利用本應用程式以任何方式侵犯別人的知識産權；或侵犯本應用程式上其他使用者之私隱以獲取其身份或任何個人資料；或破壞本應用程式、物料或／及商品之任何部分。閣下有責任判斷是否作出上述之侵權行為。

閣下不得以任何方式竄改任何材料或商品，也不得以任何方式干擾本應用程式的運營，包括但不限於傳輸軟件病毒，或者傳輸專門用來中斷、干擾或改變本應用程式運營的任何計算機代碼或消息。閣下亦不得利用任何方式收集本應用程式其他使用者的資料。在沒有Ikigai Concepts明確的許可下，本程式或其任何部分均不得翻版、復制、翻印、售賣、轉售或以其他方式利用本程式作商業用途。

10. 免責條款

本應用程式的材料可能不正確或存有排印上的錯誤。Ikigai Concepts不承認任何默示性和非明示性的保證、並且不保證本應用程式或素材的正確性、可靠性、完整性或及時性。

Ikigai Concepts對在本應用程式上的其他連結網站登載內容及連接本應用程式的任何事物，包括但不限於任何錯誤、遺漏、侵權、毀謗或者其他可能是犯法或會引起權利主張或投訴的材料或遺漏，不承擔任何責任。使用本應用程式和連結網站的材料的後果由閣下自負。該等網站可能隨時或定期會有變動，請不時查閱有關的材料。

Ikigai Concepts不保證以下事項：本應用程式目前或今後任何時候毫無錯誤，本應用程式及其伺服器目前或今後任何時候沒有計算機病毒或其他有害機能，或者本應用程式的運作是及時、安全和不會中斷的。如果由於閣下使用本應用程式材料，導致需要修理或更換設備或數據，Ikigai Concepts不負責任何由此而産生的費用。

凡由於使用或無法使用本應用程式或材料，或任何執行失敗、錯誤、遺漏、中斷、刪除、缺陷、操作或傳送的延誤、計算機病毒、通信線路失靈、線上通信的攔截、軟件或硬體問題（包括但不限於丟失數據或相容性問題）、偷竊；無論是因使用本應用程式或向本應用程式上載或從本應用程式下載或出版數據、文字、圖像或其他材料或資料而直接或間接造成的違約、侵權行為、疏忽或任何其他因素所引起的任何種類損害或傷害(包括但不限於意外損害、間接損害、利潤的損失、或者因失去數據或業務被中斷所造成的損害），且無論Ikigai Concepts是否已被告知此種損害的可能性，Ikigai Concepts或在本應用程式上提及的任何第三方在法律允許的範圍內不應承擔任何責任。

11. 賠償

如因閣下涉及違反使用條款的行為或不合法行為而引起任何的一切索賠、程式、損害賠償、傷害、債務、損失、費用和開支（包括合理的律師費用和開支），閣下同意向Ikigai Concepts、其關聯公司、高級職員、代理商或其承辦商作出補償，為其辯護並使其免受損害。

12. 協議闡釋

條文的標題和例子僅供參考，以幫助明白本使用條款，並不構成條文的定義，或限制條文的適用範圍。

13. 未棄權

若Ikigai Concepts不行使或延遲行使本協議下的權利或權力，在任何情況下無損亦不表示Ikigai Concepts放棄其任何權利或權力。

14. 轉讓

Ikigai Concepts有權轉讓本協議下Ikigai Concepts的權利和義務。但閣下無權轉讓本協議下閣下的權利和義務。

15. 可分割性

本使用條款的任何一條或多條規定、或在任何情況下引用本條款和條件的任何一條或多條規定，若在任何方面因任何原因被裁定為無效、不合法或無法執行，該條款或條件在任何其他方面的有效性、合法性或可執行性，以及本條款和條件其餘規定的有效性、合法性或可執行性，在任何方面均不受損。

16. 適用法律

本條款受香港特別行政區（「香港」）的法律管限，閣下同意將Ikigai Concepts與閣下之任何糾紛、爭議或索償交由香港法庭審理。

17. 聯絡方法

閣下如希望就本應用程式或本使用條款的事宜聯絡Ikigai Concepts，請電郵至 info@ikg.hk或以書面通知郵寄至香港新界荃灣如心廣場商場2期2樓211店 Ikigai Concepts代表收。

18. 不賦予第三者權利

除 Ikigai Concepts、其關聯公司和本應用程序的用戶外，任何人均無權根據《合約（第三者權利）條例》（香港法例第623章）（「第三者條例」）強制執行或享受這些使用條款下的任何條款。

19. 版本差異

如中、英文兩個版本有任何抵觸或不相符之處，應以英文版本為準。
